Suspect In Officer Involved Shooting In Critical Condition

MARION, OH - Chief Bill Collins and Sheriff Tim Bailey provided an update in regards to the officer involved shooting that took place in Marion on July 3rd. 

The officer involved is Officer Joseph McDonald and is a 4 year veteran of the Marion Police Department. 

The deputy involved from the Marion County Sheriff Office is Lieutenant Christy Utley, she is an 18-year-old veteran of the Marion County Sheriffs Office. 

Matthew W. Lust, the suspect involved in the shooting, is still currently in Riverside Hospital. Lust has gone through multiple surgeries and was last listed in Critical condition. 

The female shooting victim was released from the hospital but is in need of future medical care in connection with the incident. 

Marion County Prosecutor Ray Grogan obtained a warrant for Mr. Lust. The warrant is issued for the attempted murder of the female victim, Angelica Frye age 30 of Marion, who was shot on Bain Ave. Two counts of Felonious Assault in regards to the same incident are also listed on the warrant. Additional charges are possible after the investigation by the Ohio Bureau of Criminal Investigation, whose focus is specific to the Patterson Street incident. Once Lust is released from the hospital, he will be arrested on this warrant.

At 4:46 PM on July 3rd, officers from the Marion Police Department responded to a reported shooting in the area of Bain Avenue between South High and South State streets. Officers discovered a female suspect had sustained gunshot wounds inside a vehicle after being fired upon several times. The injuries were believed to be not life-threatening.

Officers received information indicating that the male suspect involved in the shooting was Matthew W. Lust, age 33 of Bucyrus. Lust was said to an estranged boyfriend of the female victim, and it was believed he may be heading to an address in the 500 block of Patterson Street to cause harm to a male. 

An officer from the Marion Police Department and a Deputy from the Marion County Sheriff's Office arrived at the location at 5:18 PM with the intention of alerting the male subject of a potential threat of violence by Lust. 

The officer and deputy encountered a male subject upon arrival at the front of the Patterson Street location which matched the description provided of Lust following the Bain Avenue shooting. In the initial interaction with law enforcement, Lust presented a firearm which resulted in an exchange of gunfire between the suspect and the two law enforcement officers. Lust was struck and wounded in the exchange. 

The officer and the deputy were unharmed. Lust was secured and transported to Marion General Hospital and subsequently flown by MedFlight to Columbus area medical facility. 

An involved firearm was recovered from the scene of the shooting. At this time, the condition of the suspect Lust is unknown. 

The Ohio Bureau of Criminal Investigation was called to the scene to assume the lead role in the investigation. 

Both the officer and deputy involved in the shooting have been placed on paid administrative leave pending the outcome of the investigation.
